Terms of Service

Effective date: 1 June 2026

These Terms of Service (“Terms”) govern your access to and use of Fanbase NG (“Platform”, “we”, “us” or “our”), a creator subscription service operated by Fanbase Technologies Limited, a company registered in the Federal Republic of Nigeria. By creating an account or using the Platform you agree to these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years old to use Fanbase NG. By using the Platform you represent that you are 18 or older and that you have the legal capacity to enter into a binding agreement. We reserve the right to terminate accounts found to belong to persons under 18.

2. Account Registration

You must provide accurate, current and complete information when registering. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at support@fanbaseng.com if you suspect unauthorised access to your account.

You may not create more than one account per person without our prior written consent. We may remove or reclaim usernames that are inactive, offensive or infringe third-party rights.

3. Creator Terms

3.1 Content Ownership

You retain all intellectual property rights in the content you upload (“Creator Content”). By publishing content on Fanbase NG you grant us a worldwide, non-exclusive, royalty-free licence to host, display, transcode, distribute and cache your content solely for the purpose of operating the Platform.

3.2 Creator Obligations

You agree that all content you publish:

  • Is your original work or you hold the necessary rights and permissions to publish it;
  • Does not depict or promote illegal activity, violence, hate speech, discrimination or harassment;
  • Does not infringe the intellectual property, privacy or publicity rights of any third party;
  • Does not contain malware, spam or deceptive material;
  • Complies with all applicable Nigerian laws, including the Cybercrimes (Prohibition, Prevention, Etc.) Act 2015 and the National Information Technology Development Agency (NITDA) Act.

3.3 Earnings and Payouts

Creators earn revenue from subscriptions, pay-per-view content, tips and messaging fees, subject to the Platform’s applicable service fee (currently 20% of gross receipts). Payouts are made in Nigerian Naira (NGN) to verified Nigerian bank accounts. Funds are subject to a clearance period (currently 7 days from receipt) before they become available for withdrawal. We reserve the right to withhold or reverse earnings if we reasonably believe they arise from fraudulent transactions, chargebacks or violations of these Terms.

Creators are solely responsible for declaring and paying any taxes owed on earnings received through the Platform in accordance with Nigerian tax law, including applicable personal income tax or withholding tax obligations.

4. Fan and Subscriber Terms

Subscription fees are billed on a recurring basis through Paystack according to the billing interval selected at checkout. Subscriptions renew automatically until cancelled. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period with no partial refunds for unused time.

Pay-per-view (PPV) content and tips are non-refundable once purchased, except where required by law or where we have expressly agreed otherwise.

5. Payments and Fees

All payments are processed by Paystack (Paystack Payments Limited), a licensed payment service provider in Nigeria. By making a payment you also agree to Paystack’s Terms of Service. We do not store your full card details; they are held by Paystack in accordance with PCI DSS standards.

All prices are displayed and charged in Nigerian Naira (NGN). We reserve the right to adjust pricing with reasonable notice to creators and subscribers.

6. Prohibited Conduct

You must not:

  • Use the Platform to engage in or facilitate fraud, money laundering or any other criminal activity;
  • Harass, threaten or abuse other users, creators or Platform staff;
  • Reverse-engineer, scrape, or attempt to gain unauthorised access to any part of the Platform or its underlying systems;
  • Circumvent subscription or access controls (e.g., sharing login credentials or screenshots of gated content without a creator’s consent);
  • Use bots, scripts or automated tools to interact with the Platform without our prior written consent;
  • Impersonate any person or entity, or misrepresent your affiliation with a person or entity.

7. Content Moderation

All content published on Fanbase NG is subject to review. We reserve the right to remove content, suspend or terminate accounts, and report illegal content to law enforcement authorities at any time, with or without prior notice, where we determine in our sole discretion that content or conduct violates these Terms, applicable law, or is otherwise harmful to users or the Platform.

8. Intellectual Property

The Fanbase NG name, logo, software, and Platform design are the exclusive property of Fanbase Technologies Limited or its licensors. Nothing in these Terms grants you any right to use our trademarks, trade names or other proprietary materials without our prior written consent.

9. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by Nigerian law, Fanbase Technologies Limited shall not be liable for any indirect, incidental, consequential, punitive or special damages arising out of or related to your use of the Platform, even if we have been advised of the possibility of such damages. Our total aggregate liability to you in respect of any claims arising under or related to these Terms shall not exceed the greater of (a) the total fees paid by you to us in the 12 months preceding the claim or (b) ₦50,000.

11. Indemnification

You agree to indemnify and hold harmless Fanbase Technologies Limited, its officers, directors, employees and agents from any claims, damages, losses and expenses (including reasonable legal fees) arising out of your use of the Platform, your content, or your violation of these Terms.

12. Termination

Either party may terminate this agreement at any time. You may terminate by closing your account. We may terminate or suspend your access immediately and without notice if you violate these Terms. Upon termination, your right to use the Platform ceases. Content you have published may be retained for a reasonable period for technical or legal reasons.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising out of or relating to these Terms shall first be referred to mediation. If mediation fails, disputes shall be resolved by the courts of competent jurisdiction in Lagos State, Nigeria.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice on the Platform at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
